No Limit Football players posing at a session

1.ENGAGEMENT & ACCEPTANCE

All agreements relating to the services supplied by No Limit Football Coaching to the player are subject to these terms to the exclusion of all other terms and conditions.
The contract shall be formed (and these terms deemed accepted by you) upon joining as a member of No Limit Football Coaching and paying the fee(s).
No variation or addition to the terms shall be binding on either party unless agreed in writing by No Limit Football Coaching and the parent.

3. BOOKINGS

booking must be made directly with No Limit Football Coaching before any player can attend a session.
No Limit Football Coaching reserve the right to not accept a player without prior arrangement/booking if the session is deemed to be full, with maximum numbers reached.
Bookings can be made in via the Mindbody app or through our secure website only. Once a booking is received, a confirmation email will be sent to the email address.
No Limit Football Coaching sessions are, generally, booked for an allocated number of weeks and these dates will be specific to the booking but may be interchangeable with other events at the discretion of No Limit Football Coaching.
If a player misses a weekly session without requesting a pause in the subscription with at least one weeks’ notice – for whatever reason – the missed week will not be credited, and they shall not be entitled to a free week in lieu.
It is the parent or carer’s responsibility to ensure that the contact details provided on the details form are correct (this is not the responsibility of No Limit Football Coaching).
All Bookings are non- transferrable, unless specifically agreed in writing by No Limit Football Coaching.

4. FEES & PAYMENT

The fee(s) payable for each membership will be specified on the No Limit Football Coaching website and shall be as stated prior to the submission of your order.
Subject to your chosen payment option, all fee(s) shall be payable immediately and in advance of any sessions. If payment is not received, players will not be formally enrolled on to the session and may be unable to attend (subject to clause 3.2 under BOOKINGS).
You must pay the fee(s) by card via our secure website.

5. ATTENDANCE

The player/carer/parent should make their own travel arrangements to and from any No Limit Football Coaching session.
The parent/carer is responsible for ensuring the player attends the course at the agreed location in good time prior to the commencement of the course.
No Limit Football Coaching is not responsible for ensuring the player attends the session nor are they expected to make, arrange, deliver or pay for travel for the player to and from the session.
No Limit Football Coaching reserves the right to exclude or refuse any player from participating in any session at any time. If a player repeatedly detracts from the objectives of the session and threatens the enjoyment or safety of others, the parents or carer will be contacted and will be asked to remove the individual. A refund shall not be payable in these circumstances.
Unacceptable behaviour (which includes swearing, bullying, name calling, physical harm) will not be tolerated by No Limit Football Coaching and if players do not behave appropriately, clause 5.4 (above) will be invoked and followed.

6. LOCATION & DELIVERY OF THE COURSE

The location of the sessions is displayed on the website or confirmation email.
No Limit Football Coaching will endeavour to deliver the sessions at the displayed location and on the date(s) specified in the confirmation email, unless exceptional circumstances or events beyond reasonable control prevent them from doing so.
The No Limit Football Coaching duty of care towards children (including the player) who are attending a session will commence at the start time of the booked session, provided that the parent/carer/guardian/authorised collector has notified us of their attendance. The duty of care ceases at the end of each session, at which time it reverts back to the parent/carer/guardian/authorised collector.

7. CANCELLATION & REFUND POLICY

You have a ‘right to cancel’ a membership prior to the first booked session commences and may receive a refund of monies paid provided that no services have been performed.
Where the membership has started, and you later decide you wish to cancel the contract; you will not be entitled to a refund but all future payments will be stopped.
If No Limit Football Coaching cancel a session and the alternative day/time is not suitable then a full refund will be issued.
All refunds shall be made within 14 days of notification.
All credit notes are given at the discretion of No Limit Football Coaching and are nontransferable.
If the venue is closed due to adverse weather or any other reason beyond the control of No Limit Football Coaching, you will not be entitled to a to a refund, but you may be entitled to a credit to the value of any part of the session that has not been delivered.

8. LIABILITY

Except in respect of death or personal injury caused by the company’s negligence, No Limit Football Coaching will not by reason of any representation, implied warranty, condition or other term, or any duty at common law or under the express terms contained herein, be liable for any losses indirect, special or consequential losses, damages, costs, expenses or other claims (whether caused by the company’s coaches, agents or otherwise) in connection with the performance of its obligations under the contract or with the use by the player of the services supplied.
No Limit Football Coaching shall not be liable to the player or be deemed to be in breach of the contract by reason of any delay in performing, or any failure to perform, any of the company’s obligations if the delay or failure was due to any cause beyond the company’s reasonable control. Except in unusual or exceptional circumstances, we expect any losses to be limited to the charges for the sessions.
The parent shall indemnify and keep indemnified No Limit Football Coaching against all loss (including loss of profit), liability, costs and expenses which the company shall incur directly or indirectly as a consequence of any action or inaction of the parent, the carer or the player.

9. GENERAL

Any notices to be sent by No Limit Football Coaching to the parent or carer shall be shared on the members Facebook group page, sent by email or SMS text message to the information given on the details form and shall be deemed to have been received by the addressee within one hour of sending.
Any notices to be sent by the parent or carer shall be sent by email or SMS text message and shall be deemed to have been received by No Limit Football Coaching once responded to.
The failure by either party to enforce at any time or for any period any or more of the obligations arising under these terms & policies shall not be a waiver of them or of the right at any time subsequently to enforce all the obligations under these terms & policies.
By agreeing to these terms & policies, the parent or carer grants media consent for No Limit Football Coaching, its coaches or agents to capture photographic images or videos of the session or event which may include the player to the be posted on No Limit Football Coaching social media pages or website.
These terms & policies constitute that the entire agreement between the parties hereto and supersede all prior agreements and understanding between the parties. It is agreed that no statement promised or inducement, whether written or orally agreed to have been made by either party which is now contained herein shall be binding or form part of this agreement.

10. NO LIMIT FOOTBALL PARTY BOOKINGS T&Cs

Please note that party booking deposits are non-refundable but are transferable to another date (with 60 days’ notice) where applicable. In the event that this is not possible to change your booking date (due to other dates being fully booked already) then you will have deemed to have cancelled the booking and will lose your deposit.
A birthday party deposit amount is £50.00. This is requested via bank transfer (bank details provided at the time of booking). By paying this you are accepting all party booking Terms and Conditions. If the deposit is not paid within 48 hours of booking, then the date may be given to another booking.
Should you need to move your party booking prior to the 60 days transfer period there is currently no administration fee. The balance of your party booking must be paid on the day of the party.
Should you need to cancel the party booking you will lose your deposit which is non-refundable. The balance of your party booking will be cleared.
The party organiser should inform No Limit of any relevant allergies at the time of booking.
It is the responsibility of the party organiser to provide all food, cutlery and party bags. Full catering is not included in the party price, simply the cake, candles and napkins.
Please note that the staff from the No Limit will provide full party entertainment, however the children remain the responsibility of the adults in the party.

11. Data protection & confidentiality

The Data Protection Act requires us to advise you that after applying for a membership your particulars are held on our database. We use your personal data for the provision of our services to you and for related purposes including: updating and enhancing player records, analysis to help us manage our practice, statutory returns and legal and regulatory compliance.

It is No Limit Football Coaching's policy to respect your privacy regarding any information we may collect while operating our website. Accordingly, we have developed this privacy policy in order for you to understand how we collect, use, communicate, disclose and otherwise make use of personal information. We have outlined our privacy policy below;

We will collect personal information by lawful and fair means and, where appropriate, with the knowledge or consent of the individual concerned.
Before or at the time of collecting personal information, we will identify the purposes for which information is being collected.
We will collect and use personal information solely for fulfilling those purposes specified by us and for other ancillary purposes, unless we obtain the consent of the individual concerned or as required by law.
Personal data should be relevant to the purposes for which it is to be used, and, to the extent necessary for those purposes, should be accurate, complete, and up-to-date.
We will protect personal information by using reasonable security safeguards against loss or theft, as well as unauthorised access, disclosure, copying, use or modification.
We will make readily available to customers information about our policies and practices relating to the management of personal information.
We will only retain personal information for as long as necessary for the fulfilment of those purposes.
We are committed to conducting our business in accordance with these principles in order to ensure that the confidentiality of personal information is protected and maintained. No Limit Football Coaching may change this privacy policy from time to time at No Limit Football Coaching's sole discretion.
